SUBJECT: AN APPEAL: JUSTICE FOR CCE-2013 (SMC 18/2016)
Honourable Chief Justice of Pakistan,
With due deference, I want to draw your attention to the suo moto which was taken by Honourable Supreme Court against the eligibility of chairman of Sindh Public Service Commission. Unfortunately the decision of this case has affected 227 candidates of CCE 2013; years of their hard work are on stake. There is feeling of deprivation in 227 families since the day the decision was announced. The candidates of CCE 2013 have been punished for the administrative policies of Sindh Public Service Commission and Sindh Government.
The three judges bench which gave verdict on March 13, 2017 included three Honourable judges of Supreme Court including Justice Retired Amir Hani Muslim, Justice Qazi Faiz Isa and Justice Mazhar Alam Khan MianKhel. The decision comprises of more than thirty pages. Page number thirty of the verdict clearly mentions that successful candidates can’t be blamed for administrative faults of made by the chairman and members of commission for whose eligibility the suo moto case was taken by Honourable Supreme Court of Pakistan have been given clean chit. The same chairman and members also conducted CCE 2013. Besides the innocence of successful candidates as mentioned in verdict and accepted by Honourable judges of the then bench the punishment of administrative faults of government and commission was awarded to the innocent candidates of CCE 2013 while twenty five hundred candidates as mentioned earlier were given clean chit. This is beyond understanding. The families of 227 are in constant state of shock, stress and deprivation since the day the decision was announced. They are waiting for justice. You are the only hope for these 227 families of Pakistan.
In order to get their due right the successful candidates have filed a review as per law. After retirement of Justice Amir Hani Muslim we the successful candidates of CCE 2013 request your worthy self to head the review bench and dispense justice to the 227 families of Pakistan.
Honourable Sir, like other 226 successful candidates I belong to humble social background. I am the only son and hope of aging parents. I have earned this job on pure merit after four years of hard work and struggle. My parents are in state of shock after the day the decision was announced in which I am being deprived of my job without any crime or malpractice. I, being a citizen of Islamic Republic of Pakistan request you guarantee my rights; Article 10-A of the Constitution guarantees a “fair trial and due process” while Article 37 promises “inexpensive and expeditious justice”.
Honourable Chief Justice of Pakistan you are the only hope of justice. Kindly help me in retaining what was mine. I will be looking forward to you as a bastion of hope and saviour of justice in Islamic Republic of Pakistan.
